In New York, the court classifies sex offenders in three risk levels for the purposes of Megan’s Law.  Level 1 offenders have a low risk of repeat offense.  Level 2 offenders have a moderate risk of repeat offense.  Level 3 offenders have a high risk of repeat offense and present a threat to the public safety.

The courts also can designate an offender as a sexual predator, a sexually violent offender, or a predicate sex offender.  All offenders are subject to Megan’s Law registration for life except for Level 1 offenders who have not been designated as a sexual predator, sexually violent offender, or predicate sex offender.

The level of notification varies by risk level.  The Division of Criminal Justice Services (DCJS) cannot post information about Level 1 offenders and cannot tell a person if a Level 1 offender is living in his or her neighborhood; however, the DCJS can reveal whether a particular person is a registered offender.

The DCJS may publish the zip code in which a Level 2 offender lives and the exact address of a Level 3 offender.
