Statutory Rape in New York City

Here are some things to know about statutory rape in New York:
- The age of consent in New York is 17 years old. The degree of the crime depends on the ages of the parties.
- A person is guilty of third-degree rape if he or she is 21 years old or older and has sex with someone younger than 17. Third-degree rape is a Class E felony.
- A person is guilty of second-degree rape if he or she is 18 years old or older and has sex with someone who is 15 years old or younger. Second-degree rape is a Class D felony.
- A person is guilty of first-degree rape if he or she has sex with someone younger than 11 years old or if he or she is 18 years old or older and has sex with someone younger than 13 years old. First-degree rape is a Class B felony.
